1. Acceptance of Terms

By accessing or using the PetAftercare website, services, or platform (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and PetAftercare.

2. Eligibility and Access Restrictions

• Veterinary Professionals: Licensed veterinarians, veterinary technicians, and authorized staff members of veterinary clinics that have entered into a partnership or service agreement with PetAftercare.
• Authorized Pet Owners: Pet owners who have been specifically granted access to the Service by a participating veterinary clinic or by PetAftercare directly, and who have received explicit authorization to use the Service for their pet's aftercare needs.
• Authorized Regulatory Agencies: PetAftercare offers compliance access to authorized regulatory agencies via our compliance dashboard. If you represent an authorized regulatory agency and require access for compliance purposes, please reach out to us to obtain an access token. Access is granted only to agencies acting in an authorized regulatory capacity.

Authorized Use Only: Access to the Service is granted solely for legitimate business purposes related to pet aftercare services, veterinary clinic operations, or authorized regulatory compliance activities. The Service may not be used for any purpose other than those expressly authorized herein.

Unauthorized Use Prohibited: Any use of the Service by individuals who do not fall into one of the above categories is strictly prohibited. Unauthorized access, use, or attempts to access the Service may result in immediate termination of access and may subject violators to legal action. PetAftercare reserves the right to verify user eligibility at any time and to deny or revoke access to any user who does not meet these eligibility requirements or who uses the Service for unauthorized purposes.

3. Description of Services

PetAftercare provides compassionate pet aftercare services, including but not limited to:

• Pet collection and transportation services
• Cremation and aftercare services
• Home delivery of ashes and keepsakes
• Memorial products and keepsakes
• Pet tracking and status updates
• Grief support resources
• Veterinary clinic partnership services

PetAftercare reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

4. User Accounts and Registration

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate, current, and complete
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify PetAftercare immediately of any unauthorized use of your account

PetAftercare reserves the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

5. Payment Terms

If you purchase services through the Service, you agree to pay all fees and charges associated with your purchase. All fees are in New Zealand Dollars (NZD) unless otherwise stated. Payment terms, refund policies, and pricing are subject to change at PetAftercare's discretion. You are responsible for any applicable taxes.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. 7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, software, and the compilation thereof, are the property of PetAftercare or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Service without prior written permission from PetAftercare.

8. Prohibited Uses

You agree not to use the Service:

• For any unlawful purpose or in violation of any applicable laws or regulations
• To transmit any malicious code, viruses, or harmful software
• To attempt to gain unauthorized access to any portion of the Service
• To interfere with or disrupt the Service or servers connected to the Service
• To impersonate any person or entity or misrepresent your affiliation with any person or entity
• To collect or store personal data about other users without their consent
• For any commercial purpose not expressly authorized by PetAftercare
• To monitor, surveil, or gather information about PetAftercare, its operations, or its services for purposes of filing complaints, reports, or regulatory actions against PetAftercare
• To use the Service in bad faith or for the purpose of causing harm, disruption, or adverse regulatory action against PetAftercare or its business operations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETAFTERCARE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL PETAFTERCARE'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO PETAFTERCARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PetAftercare and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

PetAftercare may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

PetAftercare reserves the right to modify or replace these Terms at any time at its sole discretion. If we make material changes to these Terms, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by PetAftercare on the Service, shall constitute the entire agreement between you and PetAftercare concerning the Service.
